Understanding Florida Law and Your Rights

What is Wrongful Death?

Under Florida law, a wrongful death occurs when a person or entity causes another person’s death by a “wrongful act, negligence, default, or breach of contract or warranty.” (Fla. Stat. § 768.19 (2021).) In other words, a wrongful death occurs when one person dies due to the legal fault of another party, including as a result of:

  • A negligence-based incident (such as a car accident)
  • Medical malpractice
  • A defective product, or
  • An intentional act (including a crime).

Who Can File a Wrongful Death Lawsuit?

In Florida, the personal representative of the deceased individual’s estate may file a wrongful death claim. Additionally, the court may appoint a personal representative if one has not yet been appointed. Under Florida law, the personal representative is responsible for bringing a wrongful death action on behalf of certain beneficiaries of the deceased. These beneficiaries generally include the deceased individual’s surviving spouse, children, and parents.

How Can a Wrongful Death Claim Help?

A successful wrongful death claim can help the surviving family members of the deceased recover the monetary damages they have suffered as a result of their loved one’s passing. These damages may include medical expenses, funeral expenses, and loss of financial support for the family. Additionally, family members may be able to recover compensation for pain and suffering and emotional distress. Pursuing a wrongful death claim can be an important step in helping to ensure that your family is taken care of after the passing of your loved one.
